Whats the deal with jurisdiction?

There is a lot of confusion out there regarding which court has jurisdiction over divorce in Israel. This stems from the fact that although the religious courts have exclusive jurisdiction over the “divorce” – the legal termination of the marriage -, jurisdiction for all of the other matters connected with the divorce can be heard by the civil family court (i.e. custody, division of assets, maintenance, etc.).  This can lead to a “race” between the spouses to see who determines which court will be making decisions about which issues.

Also, depending on how long you are in Israel for, and where you are from, or if one of the spouses resides outside of Israel, a court from a third country might be the proper place for the divorce litigation.

Additionally, if the couple getting divorced have different religions or are members of a religion without a court system of its own in Israel, then there is a different type of procedure for getting divorced.
