When people are planning on getting a divorce, many times they are unsure about and want to know what assets will be split between themselves and their spouse. In Israel all the assets that a couple accumulates during the course of your marriage are going to be equitably divided, however there are certain exceptions. For example, if the couple had a valid prenuptial agreement then the courts (both the Rabbinic and the Family courts) are generally going to divide the assets as per the prenuptial agreement. Some other exceptions are inheritances (if the inheritance received prior to or during the course of the marriage) was kept totally separate from joint assets. This includes, in the example of a house which was inherited, that the rent collected went into a totally separate account and was not commingled with family assets or used to cover family expenses. The same goes for certain pre-marital assets which one side may have held – again with the proviso that these assets were kept totally separate from joint and/or family assets (i.e. money wasn’t commingled or used to support the family’s lifestyle).
